Terms of Service

These Terms of Service ("Terms") govern your use of the SalesPowder CRM platform ("Service") operated by SalesPowder ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Account Registration

To use SalesPowder, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.
  • Notifying us immediately of any unauthorized use of your account.

You must be at least 18 years old to create an account.

2. Subscription and Billing

  • The SalesPowder CRM subscription is $99 per month, which includes one admin user.
  • Additional users are $15 per month per user.
  • Subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
  • User counts are automatically adjusted when users are added or removed from your account.
  • All fees are non-refundable except as required by law.

3. Free Trial

We may offer a free trial period at our discretion. At the end of the trial, your account will be billed unless you cancel before the trial expires.

4. Cancellation

  • You may cancel your subscription at any time through the Billing Portal in your account settings.
  • Upon cancellation, your access continues through the end of the current billing period.
  • After the billing period ends, your account will be suspended and your data will be retained for 30 days before deletion.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Send spam, unsolicited messages, or bulk emails that violate CAN-SPAM or similar laws.
  • Upload malicious code, viruses, or harmful files.
  • Attempt to gain unauthorized access to the Service or other users' accounts.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the platform for any illegal, fraudulent, or abusive purpose.

We reserve the right to suspend or terminate accounts that violate these terms.

6. Your Data

  • You retain ownership of all data you enter into SalesPowder (contacts, emails, files, notes, etc.).
  • We do not access, sell, or share your data with third parties except as needed to operate the Service (see our Privacy Policy).
  • You are responsible for the accuracy and legality of the data you store in the platform.
  • You are responsible for maintaining your own backups. While we take reasonable measures to protect your data, we are not liable for data loss.

7. Email and SMS Messaging

SalesPowder provides email and SMS capabilities through integrated third-party services (SendGrid and Twilio). By using these features, you agree to:

  • Comply with all applicable anti-spam and telecommunications laws, including CAN-SPAM and TCPA.
  • Only send messages to recipients who have given appropriate consent.
  • Include accurate sender information and provide opt-out mechanisms where required.

We may suspend messaging capabilities if we detect misuse or policy violations.

8. Integrations

SalesPowder integrates with third-party services including Google Calendar, QuickBooks, AWS S3, SendGrid, and Twilio. These integrations are subject to the respective third-party terms of service. We are not responsible for the availability or functionality of third-party services.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable advance notice when possible. We are not liable for downtime caused by factors beyond our control.

10. Limitation of Liability

To the maximum extent permitted by law, SalesPowder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify and hold harmless SalesPowder, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the appropriate courts.
